Eligibility to Appear in the Government Patent Agent Exam

As per the Patent Rules, 2003, candidates must fulfill the following criteria:

Citizenship

Must be a citizen of India.

Education

Candidates with a degree in science, engineering, technology, or an equivalent qualification (such as B.Sc., M.Sc., B.E., M.E., B.Tech., M.Tech., B.Pharm., M.Pharm., or Ph.D. in any related field) from a recognized Indian university are eligible to sit for the Patent Agent Exam.

Age Limit

There is no specific age limit to appear for the exam. However, you must be at least 21 years old at the time of applying.

Work Experience

While work experience is not mandatory, having practical experience in the field of patents or intellectual property can be an added advantage.

Exam Pattern

✅ Conducted By: Office of the Controller General of Patents, Designs & Trademarks (CGPDTM)
✅ Purpose: Assesses knowledge of the Patents Act, 1970 & ability to draft/file patents

✅ Viva-Voce Examination:
✅ Marks: 50
✅ Evaluates practical knowledge & communication in patent law, filing & prosecution

✅ Minimum Qualifying Marks:
✅ Paper I: 50%
✅ Paper II: 50%
✅ Viva-Voce: 50%

✅ Overall Pass Criteria (expected):
✅ Minimum 60% aggregate (Written + Viva)

✅ Regulation Reference: As per Rule 110 of Patent Rules, 2003 (amended)

Patent Agent Examination 2026-2027 is expected to be held in December 2026 at locations
Ahmedabad, Bangalore, Bhopal, Chandigarh, Chennai, Delhi, Guwahati, Hyderabad, Kolkata,
Lucknow, Mumbai, Nagpur and Thiruvananthapuram.

The Patent Agent Exam in India is conducted by the Indian Patent Office under the Controller General of Patents, Designs & Trade Marks (CGPDTM). The exam is divided into two written papers and an oral viva voce examination. Below is the syllabus and a paper-wise overview:
